In California, yes, when the image is altered. Since 1 January 2026 a broker or salesperson who uses a digitally altered image in an ad must say so on or next to it and link to the original (AB 723, Business and Professions Code 10140.8, checked 2026-10-08). Virtual staging, paint, flooring, landscaping and window views count; lighting, white balance and cropping do not. Local MLS rules can be stricter, so check yours before you post.
